You may upload photos, videos, text, and other content ("User Content") to your profile and messages. By submitting User Content, you:
You retain ownership of your User Content. We do not sell your photos or videos to third parties. You can delete your content at any time by deleting your account.
Prohibited content includes: nudity or sexually explicit material, images of minors, content depicting violence or self-harm, and any content that violates applicable law.
To maintain a safe environment, Vesper uses a liveness verification process during profile creation. By completing this process, you confirm that you are a live person and that the video and photos you submit are genuine and current representations of you.
Attempting to bypass or spoof liveness verification is a material breach of these Terms and will result in immediate account termination.
The messaging feature is available only to mutually matched users. You agree to use messaging respectfully and in good faith. We may monitor messages for safety and policy compliance. Do not share personal contact information (phone numbers, addresses) with users you don't trust.
You may block or report any user at any time. When you report a user, we review the report and may take action up to and including permanent account removal. Reports are confidential. Misuse of the reporting feature is itself a violation of these Terms.
All content, features, and functionality of the Service (excluding User Content) — including but not limited to design, trademarks, logos, text, graphics, and software — are owned by or licensed to Vesper and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to our data practices as described in the Privacy Policy.
You may delete your account at any time from your Profile Settings. Upon deletion, your profile is immediately hidden from discovery. Your data is permanently erased after a 30-day grace period, during which you may reactivate your account.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, endangered other users, or for any other reason at our discretion.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We make no guarantee regarding the accuracy of user profiles or the outcome of any connection made through the Service.
To the fullest extent permitted by applicable law, Vesper and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total aggregate liability to you for any claim shall not exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim.
You agree to defend, indemnify, and hold harmless Vesper and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, please stop using the Service and delete your account.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vesper operates, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
